**General Terms and Conditions (GTC)**
for the use of the website *zenplanet.de*
### 1. Scope of application
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of *zenplanet.de* (hereinafter referred to as “Seller”) apply to all contracts concluded between a consumer or entrepreneur (hereinafter referred to as “Customer”) and the Seller relating to the goods and services presented by the Seller in his online shop. Unless otherwise agreed, the Customer’s own terms and conditions are hereby expressly rejected.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.
1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
1.4 We do not offer any products for purchase by minors. If the customer is under 18 years of age, *zenplanet.de* may only be used with the involvement of a parent or guardian.

### 2. Conclusion of contract
2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers on the part of the Seller, but merely serve to submit a binding offer by the Customer.
2.2 The customer’s order represents an offer to *zenplanet.de* to conclude a purchase contract.
2.3 After placing the order, we will send the customer a message confirming receipt of the order and listing its details (order confirmation). This order confirmation does not constitute acceptance of the customer’s offer. A purchase contract is only concluded when we send the ordered product to the customer and confirm the shipment with a second email (shipping confirmation). In the case of ordering a service, the contract is concluded when the seller sends a written order confirmation by email.
2.4 When ordering data storage media that are not suitable for minors (FSK or USK-18 items), the customer confirms by submitting the order that he has reached the legally required minimum age.

### 3. Prices and payment
3.1 Unless otherwise stated in the seller’s item description, the prices quoted are total prices that include statutory sales tax. Each delivered product remains the property of *zenplanet.de* until full payment has been made.
3.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which must be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also arise if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
3.3 The payment options will be communicated to the customer in the seller’s online shop.
3.4 If advance payment by bank transfer is agreed, payment is due immediately after conclusion of the contract, unless the parties have agreed on a later due date.

### 4. Right of withdrawal
4.1 Consumers generally have a right of withdrawal.
4.2 Further information on the right of withdrawal can be found in the seller’s cancellation policy.
4.3 The right of withdrawal does not apply to consumers who, at the time the contract is concluded, are not members of a member state of the European Union and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

### 5. Accuracy of billing and account information
5.1 The Seller reserves the right to cancel or limit orders.
5.2 In case of changes or cancellations, the customer will be notified by email or telephone.
5.3 The Customer agrees to provide current, complete and accurate purchase and account information.

### 6. Redemption of promotional vouchers
6.1 Promotional vouchers can only be redeemed in the *zenplanet.de* online shop and within the specified period.
6.2 Vouchers cannot be redeemed for cash or subsequently offset.

### 7. Redemption of gift vouchers
7.1 Gift vouchers can be redeemed until the end of the third year after purchase.
7.2 The remaining balance of a gift voucher will not be paid out in cash.

### 8. Use of customer data
All data relating to the business relationship with the customer will be treated in accordance with the data protection regulations. For inquiries regarding data protection, the seller is available at * support@zenplanet.de *.

**9. User Comments, Feedback and Submissions**
**9.1** If, at our request, you send certain specific submissions (for example contest entries) or unsolicited creative ideas, suggestions, proposals, plans, or other materials (collectively, ‘comments’) to us, by email, postal mail, or otherwise, you agree that we may, at any time, without restriction, edit, reproduce, publish, distribute, translate or use in any form or medium those comments.
**9.2** We are under no obligation (1) to maintain any Comments in confidence, (2) to pay any compensation for any Comments, or (3) to respond to any Comments.
**9.3** We reserve the right, but have no obligation, to monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.
**9.4** You warrant that your comments do not violate any right of any third party, including copyright, trademark, privacy or personality right, and that they do not contain any unlawful, offensive, hateful or obscene content, or viruses or other malicious software that could in any way affect the operation of the Services or the Website.
**9.5** You may not use a false e-mail address, pretend to be another person, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for the content and accuracy of your comments.
**9.6** We assume no responsibility or liability for any comments posted by you or any third-party.

**10. Warranty**
**10.1** The seller does not guarantee the quality of the goods within the meaning of Section 443 of the German Civil Code (BGB).
**10.2** Liability for normal wear and tear is excluded. The seller is not liable for defects or damage caused by unsuitable or improper use, disregard of application instructions or improper handling. This applies in particular to using the products with the wrong type or voltage of current or when connecting them to unsuitable power sources. The same applies to damage caused by fire, lightning, explosion or overvoltage, moisture or missing software or processing data, unless the customer can prove that these factors are not the cause of the defect.
**10.3** In the event of a defect, the customer, if he is a consumer, has the choice of either requesting the defect to be remedied or delivery of a defect-free product. If the selected form of subsequent performance causes disproportionately high costs, the claim can be limited to the remaining form of subsequent performance. The exchange for a higher-quality model is considered accepted by the customer if this is reasonable for both parties. Further rights, in particular a reversal of the contract, can only be asserted after a reasonable period of time for subsequent performance or after two failed attempts at subsequent performance.

**11. Liability**
**11.1** The seller is fully liable for damages caused by intent or gross negligence, intentional or negligent injury to life, body or health, due to a guarantee promise or due to mandatory liability, for example under the Product Liability Act.
**11.2** In the event of negligent breach of a material contractual obligation, the seller’s liability is limited to the damage that is typical for the contract and foreseeable, unless unlimited liability exists in accordance with the first paragraph. Material contractual obligations are those that are crucial for achieving the purpose of the contract and whose fulfillment is essential for the proper execution of the contract.
**11.3** The Seller shall not be liable for the restoration of data unless the loss was caused intentionally or through gross negligence and the Customer has previously backed up the data so that the data can be restored with reasonable effort.
**11.4** The Seller shall not be liable for the loss of shipments under a storage or garage contract, unless otherwise agreed.
**11.5** These liability regulations also apply to the liability of the seller for his vicarious agents and legal representatives.
**11.6** The Seller is not affiliated with the manufacturers or publishers of the games mentioned on this site and assumes no liability for problems arising from updates or changes to these games.
**11.7** Any further liability of the seller is excluded.

**12. Withdrawal in case of deterioration of assets**
The seller may withdraw from the contract if there are signs of a deterioration in the customer’s financial situation, such as cessation of payments, insolvency or protests of bills of exchange.

**13. Delivery and shipping conditions**
**13.1** Delivery will be made to the delivery address provided by the customer, unless otherwise agreed. If PayPal is selected as the payment method, the address provided at the time of payment applies.
**13.2** If the delivery cannot be made due to the customer, the customer shall bear the costs incurred thereby, except in the case of effective exercise of the right of withdrawal.
**13.3** For consumers, the risk of accidental loss and deterioration of the goods passes to the customer or an authorized person upon delivery.
**13.4** The seller may withdraw from the contract if the goods are not delivered properly. In such cases, the customer will be informed immediately and the payment will be refunded.
**13.5** Vouchers will be sent by email within 24 hours.
**13.6** Content will also be made available to the customer via email.
**13.7** Partial deliveries are permitted if they are reasonable for the customer.
**13.8** The Seller shall determine the shipping method and shipping company at its sole discretion, unless the Customer expressly provides other instructions.

**14. Place of jurisdiction / Applicable law / Severability clause**
**14.1** For customers who are merchants or legal entities under public law, the seller’s place of business is the exclusive place of jurisdiction. If the customer is based outside Germany, the seller’s place of business remains the exclusive place of jurisdiction.
**14.2** German law applies, with the exception of the provisions of international sales law. This choice of law only applies if the statutory protection of the consumer is not withdrawn by mandatory provisions of the law of the state of the consumer’s habitual residence.
**14.3** This choice of law does not apply if the consumer is resident outside the European Union.
**14.4** If individual provisions are invalid, the remaining provisions shall remain valid.

**15th offer: Zen Planet – Individually adapted**
The Cronus Zen is customized according to the customer’s requirements for the selected console and programmed with the script requested by the customer. The customer must make any adjustments themselves after receiving the product. If this is not done, the Cronus Zen will not work as expected.
**PS5 Update**: Starting January 24, 2024, Cronus Zen will require a PC or Mac to play PlayStation 5 games.

**16. Offer: GPC scripts – individually made**
The desired GPC script is created individually for the customer and sent via email. The customer must load it onto the Cronus Zen in Zen Studio and adapt it. Here, too, manual configuration is required for the script to work as desired.

**17th offer: Zen Planet vouchers**
After ordering, the voucher will be sent by email within 24 hours. Vouchers are valid for 3 years from the invoice date and are usually delivered one working day after the invoice date.
**18. Scope
These general terms and conditions (GTC) apply to all services and products offered by ZenPlanet. By purchasing a product or using a service, the customer accepts these GTC.
**19. Description of services
ZenPlanet offers technical support for setting up CronusZen devices, including individual assistance via Discord call, screen sharing or video call.
When purchasing, the customer expressly agrees that the service will be carried out via a Discord call and, if necessary, via a screen sharing or video call in order to explain and support the setup in the best possible way.
Our service is purely advisory and supportive. No software is installed, nor is direct access to the customer’s device (e.g. via remote control software such as AnyDesk) provided.
The service is considered fully provided as soon as the agreed setup has been completed.
**20. Customer consent
By purchasing a product or ordering a service, the customer agrees that:
ZenPlanet provides support via Discord call and screen sharing or video call.
Collaboration requires these methods for better communication and explanation.
The customer is obliged to ensure that the technical requirements (e.g. functioning Discord, stable internet) are met throughout the service.
**21. Customer’s obligations
The customer undertakes to communicate respectfully with our employees during the collaboration. Insults, threats or other inappropriate behavior will not be tolerated.
The customer is responsible for the accuracy of the information provided.
The customer undertakes not to make false accusations, such as hacking allegations, against ZenPlanet or its employees.
**22. Disclaimer
ZenPlanet is not liable for damage caused by improper use of the CronusZen device or by changes to the settings made by the customer.
We accept no liability for misunderstandings or problems that are beyond our control (e.g. faulty hardware).
Any claim of unauthorized access or manipulation by ZenPlanet is unfounded, as we do not use any remote control software.
**23. Termination of service
ZenPlanet reserves the right to terminate the service immediately if the customer:
makes insults or disrespectful statements towards employees,
makes false accusations, or
violates these terms and conditions.
In such cases, the customer will be permanently denied access to our platforms (e.g. Discord servers) and the money will no longer be refunded.
**24. Data protection
All data collected during the service is used exclusively for the implementation of the support and is not passed on to third parties.
By using screen sharing or video calls, the customer agrees that these methods are only used to better explain and support the service. ZenPlanet does not record or store such transmissions.
**25. Consequences of violations
Should the customer violate these terms and conditions, ZenPlanet reserves the right to take legal action, in particular in the case of:
insults,
defamatory statements, and
slander.
The customer is responsible for all damages or costs resulting from his behavior.
**26. Final provisions
The law of the Federal Republic of Germany applies.
Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
Controller adapter customization service”
I, ZEN_DE, offer a custom customization and setup service for the Cronus Zen. 🎮 This service includes basic configuration and optimization of the adapter so that it works seamlessly with your existing devices. ⚙️
Note:
• 📌 The service is limited to technical setup and optimization.
• ❌ I do not support applications or configurations that violate the terms of use of software, games or platforms.

Payment and prices
• 💳 Prices for services are to be agreed in advance and paid in full by the customer before the service is provided.

Final provisions

We only offer our service to set up the script or system so that it works properly. Please note that the subsequent use of the script is at your own risk.
